Terms of Service

1. Acceptance of Terms

Welcome to Hog & Nog ("the Platform," "we," "us," or "our"). By accessing or using our eggnog competition platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform.

We reserve the right to modify these Terms at any time. Your continued use of the Platform after changes are posted constitutes acceptance of the modified Terms.

2. Eligibility

You must be at least 21 years of age (the legal drinking age in the United States) to use this Platform. By using the Platform, you represent and warrant that you meet this age requirement.

The Platform is intended for personal, non-commercial use in connection with eggnog competitions and related social events.

3. Account Registration and Security

Registration

To participate in competitions, you must create an account. You may register using:

  • Email and password
  • Google OAuth authentication
  • Apple Sign In

Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach

We are not liable for any loss or damage arising from your failure to maintain account security.

4. User Conduct and Content

Acceptable Use

You agree not to:

  • Submit false, misleading, or fraudulent information
  • Impersonate any person or entity
  • Upload malicious code, viruses, or harmful content
  • Interfere with or disrupt the Platform's functionality
  • Attempt to gain unauthorized access to other users' accounts
  • Use the Platform for any illegal or unauthorized purpose
  • Harass, abuse, or harm other users
  • Submit content that is offensive, obscene, or violates others' rights

User-Generated Content

By submitting content (recipes, photos, descriptions) to the Platform, you:

  • Represent that you own or have rights to the content
  • Grant us a non-exclusive, worldwide license to use, display, and distribute your content within the Platform
  • Agree that your submissions may be visible to other competition participants
  • Acknowledge that we may use AI services to process your images

5. Competition Rules

Participation

  • Competition participation is subject to invitation or referral requirements
  • You may only submit entries that you personally created
  • Submission deadlines are final and no late entries will be accepted
  • Competition administrators reserve the right to disqualify any entry that violates these Terms

Voting and Scoring

  • Voting must be fair and honest
  • Vote manipulation or fraud will result in disqualification
  • Scoring decisions by designated judges are final
  • Competition results are determined by Platform administrators

Prizes and Awards

  • Prizes, if any, are awarded at the discretion of competition organizers
  • Prize eligibility may be subject to additional terms
  • No cash value is guaranteed for any awards or recognition

6. Intellectual Property

Platform Ownership

The Platform, including its design, features, functionality, and content (excluding user-generated content), is owned by us and protected by copyright, trademark, and other intellectual property laws.

Your Content

You retain ownership of content you submit, but grant us the necessary rights to operate the Platform and display your submissions within competitions.

7. Third-Party Services

The Platform integrates with third-party services:

  • Google OAuth: Subject to Google's terms of service
  • Apple Sign In: Subject to Apple's terms of service
  • AWS S3: For image storage
  • OpenAI: For AI-generated images and content processing

Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.

8. Privacy and Data Protection

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties regarding accuracy, reliability, or availability
  • Warranties that the Platform will be uninterrupted or error-free

We do not guarantee that the Platform will meet your requirements or that any errors will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Platform
  • Any unauthorized access to or use of our servers and/or personal information
  • Any interruption or cessation of transmission to or from the Platform
  • Any bugs, viruses, or harmful code transmitted through the Platform
  • Any errors or omissions in content or loss of content

11. Indemnification

You agree to indemnify, defend, and hold harmless Hog & Nog, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

  • Your access to or use of the Platform
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your user-generated content

12. Termination

We reserve the right to suspend or terminate your account and access to the Platform at any time, with or without notice, for any reason, including:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Extended periods of inactivity

Upon termination, your right to use the Platform will immediately cease. We may delete your account and content, though we may retain certain data as required by law or for legitimate business purposes.

13. Modifications to the Platform

We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time without notice or liability. We are not obligated to provide updates or maintain any particular features.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Platform operates, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Platform shall be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration or in the courts of the appropriate jurisdiction.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced with a valid provision that most closely matches the intent of the original.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hog & Nog regarding the use of the Platform and supersede all prior agreements and understandings.

18. Responsible Drinking

This Platform facilitates competitions involving alcoholic beverages. We strongly encourage responsible consumption of alcohol:

  • Be aware of local laws regarding alcohol consumption
  • Consider the health implications of alcohol consumption

By using this Platform, you acknowledge that you are of legal drinking age and agree to consume alcohol responsibly.
